DECISION No. 21 OF NOVEMBER 14, 1996 ON CC No. 19/96

On September 17, 1996 a total of 74 Members of Parliament challenged the constitutionality of a number of provisions of the Law on Radio and Television (LRTv) promulgated DV, No. 77/1996, viz.:
Art. 3 para 1; Art. 4 items 1, 6 and 7; Art. 8 para 2; Art. 9; Art. 15 items 2 and 3; Art. 19 para 1 in fine, concerning the words "in compliance with its approved program documents"; Art. 22; Art. 25 para 2; Art. 26; Art. 28; Art. 32 para 1; Art. 65 para 3; Art. 67 para 2; Art. 72; Art. 73; Art. 74; Art. 75 para 3; Art. 78; Art. 80; Art. 85 para 1; Art. 88; Art. 89.
On grounds of Art. 149 paras 1 and 2 of the C. the Constitutional Court found the following provisions of the Law on Radio and Television (DV, No. 77/1996) to be anticonstitutional: Art. 4 item 1 concerning the expression "respect for the constitutional order" and item 7 concerning the expression "and slander"; Art. 8 para 2 concerning the expression "state"; Art. 9; Art. 19 para 1 concerning the expression "in compliance with its approved programme documents"; Art. 25 para 2; Art. 26 except for its effect vis a vis the BNR and BNTv; Art. 67 paras 2 and 3; Art. 72; Art. 73; Art. 74; Art. 75 para 3; Art. 78; Art. 80 para 1; Art. 85 para 1 and Art. 89 and Clause 4 para 2 of the Transitional and Concluding Provisions of the LRTv regarding the expression "within three years of the date of their election."
The remainder of the challenge was turned down.
