Senior Referendary Desislava Kemalova participated in the 22nd annual meeting of the Joint Council on Constitutional Justice (JCCJ) of the Venice Commission
The future of constitutional complaint mechanisms was the main topic of a conference organized by the Joint Council on Constitutional Justice (JCCJ) of the Venice Commission. The Council’s 22nd annual meeting is taking place in Zagreb from May 21 to 22.
The representative of the Constitutional Court of Bulgaria – Senior Referendary Desislava Kemalova – highlighted the Court’s current practice regarding the admissibility of requests submitted by courts in the country following the amendment of the Constitution in 2023.
In her report during the conference’s third working panel – “Comparative Models of Constitutional Complaint” – she noted that the existing mechanisms in Bulgaria for access to constitutional justice provide sufficient effective protection of citizens’ rights, even in the absence of an individual constitutional complaint. The future introduction of new mechanisms should be based on an assessment and analysis of numerous factors, she added.
Discussions on the first day of the forum in Zagreb also focused on admissibility criteria and filtering mechanisms, as well as on the need to balance to access justice with judicial efficiency.
