At its sitting on July 21, 2026, the Constitutional Court ruled on Constitutional Case No. 18/2025. The case was initiated at the request of fifty-one members of the 51st National Assembly, and Judge Orlin Kolev served as the reporting judge.
The Court declared unconstitutional the provisions of Article 4, paragraph 3, in the part “with the exception of those under Chapter Four ‘a’”; Article 27a, paragraph 3, in the part “as well as a person engaged in the storage, transportation, or wholesale and retail trade of petroleum and petroleum products”; Article 27c, paragraph 1, item 1, in the part “or to a person engaged in the storage, transportation, or wholesale and retail trade of petroleum and petroleum products”; Article 27c, paragraphs 3–9 and paragraph 10, first sentence, in the part “and to a person engaged in the storage, transportation, or wholesale and retail trade of petroleum and petroleum products,” as well as the second sentence of the Law on the Administrative Regulation of Economic Activities Related to Petroleum and Petroleum Products (published in the State Gazette, No. 62 of 2018, last amended and supplemented in the State Gazette, No. 55 of 2026).
The Court rejected the request to declare unconstitutional the remaining part of the provision of Article 27c, paragraph 10, of the Law on the Administrative Regulation of Economic Activities Related to Petroleum and Petroleum Products (published in the State Gazette, No. 62 of 2018, as last amended and supplemented in State Gazette No. 55 of 2026).
The Court dismissed the proceedings regarding the request to declare unconstitutional the provision of Article 27c, paragraph 10, third sentence of the Law on the Administrative Regulation of Economic Activities Related to Petroleum and Petroleum Products (as amended, State Gazette No. 97 of 2025).
All 12 constitutional judges participated in the sitting.
