On July 31, 2026, the Constitutional Court initiated Constitutional Case No. 17/2026 at the request of 53 members of the 52nd National Assembly to determine the unconstitutionality of § 7, item 2 of the Transitional and Final Provisions of the 2026 State Social Security Budget Act (published in the State Gazette, No. 68 of July 28, 2026), which created Article 113a of the Health Act, and, following the provision’s entry into force, Article 113a of the Health Act, due to its inconsistency with Article 4, paragraphs 1 and 2; Article 8; Article 31, paragraphs 3 and 4; Article 51, paragraphs 1 and 3; Article 56; and Article 117, paragraph 2 of the Constitution.
