On July 31, 2026, the Constitutional Court initiated Constitutional Case No. 16/2026 at the request of 53 members of the 52nd National Assembly to determine the unconstitutionality of:

  • § 11, items 1–4 of the transitional and final provisions of the Law on the State Budget of the Republic of Bulgaria for 2026 (published in the State Gazette, No. 69 of July 31, 2026), and, upon their entry into force, Article 355, paragraph 1 of the Labor Code in the portion regarding “hours”; Article 355, paragraph 2; Article 355(3) in the part amended by § 11, item 3; and Article 355(4) of the Labor Code, due to their inconsistency with Article 4(1), Article 6(2), Article 16, and Article 48(1) and (5) of the Constitution.
  • Article 218, paragraph 2, of the Judiciary Act, as amended by § 21, item 1, of the Transitional and Final Provisions of the Law on the State Budget of the Republic of Bulgaria for 2026, on the grounds that it is inconsistent with Article 4, paragraph 1, Article 8, Article 117, paragraphs 2 and 3, and Article 133 of the Constitution.
  •  § 46, paras. 1 and 2 of the Transitional and Final Provisions of the Law on the State Budget of the Republic of Bulgaria for 2026, on the grounds that it is inconsistent with Art. 4, para. 1, Art. 16, and Art. 48, paras. 1 and 5 of the Constitution.
