At its sitting on June 16, 2026, the Constitutional Court admitted for consideration on the merits the request of the 1st Panel of the Pleven District Court to declare unconstitutional Article 53, paragraph 1, subparagraph “a” of the Penal Code (published in the State Gazette, No. 26 of 1968, last amended and supplemented in No. 32 of 2026). The reporting judge in Case No. 11/2026 is Judge Nadezhda Dzhelepova.
All 12 constitutional judges participated in the sitting.
The Resolution was adopted with 11 votes „in favor“ and a dissenting opinion by Judge Atanas Semov, which will be published on the Constitutional Court’s website at a later date.
