Today, 19 February 2026, the Constitutional Court initiated Constitutional Case No. 5/2026 at the request of the Supreme Bar Council to establish the unconstitutionality of the provisions of Article 280(3) of the Civil Procedure Code, which prevents cassation appeals against certain judicial acts on the basis of criteria related to material interest and the subject matter of the dispute in civil and commercial cases, as contrary to Articles 6 and 56 in conjunction with Articles 122 and 124 of the Constitution of the Republic of Bulgaria.
The rapporteur for the case is Judge Borislav Belazelkov.
