19-02-2026

At its sitting on 19 February 2026, the Constitutional Court ruled on constitutional case No. 13/2025, rejecting the request of 49 members of the 51st National Assembly to establish the unconstitutionality of Article 8, paragraph 4, and Article 9, paragraphs 8 and 9, of the Anti-Corruption Act (published in State Gazette No. 84 of 2023; repealed, State Gazette No. 16 of 10.02.2026) and the Decision on the adoption of Rules for the activities of the Nomination Committee and the conduct of the nomination procedure, consideration of candidacies, and election of members of the Anti-Corruption Commission, adopted by the 51st National Assembly on July 11, 2025 (published in State Gazette No. 58 of 2025), and terminates the proceedings in the case.

In the grounds for its ruling, the Constitutional Court states that it rejects the request and terminates the proceedings because, prior to ruling on the merits of the request, the Law Amending and Supplementing the Law on the Court of Auditors, adopted by the 51st National Assembly on January 28, 2026, published in the State Gazette, No. 16 of February 10, 2026, repealed the Anti-Corruption Act (published in the State Gazette, No. 84 of 2023; amended, No. 13 of 2024 and No. 57 of 2025), part of which are the contested provisions, as a result of which case No. 13/2025 remains without subject matter.

The Ruling was adopted unanimously.
