At its sitting on February 5, 2026, the Constitutional Court admitted for consideration on the merits the request of the Supreme Bar Council to establish the unconstitutionality of Article 368, paragraph 3; Article 368, paragraph 2, second sentence, in the part: "the prosecutor under paragraph 3" of the Penal Procedure Code (published in State Gazette No. 86 of 2005, last amended and supplemented State Gazette No. 97 of 2025) and §8 of the Transitional Provisions of the Law Amending and Supplementing the Penal Procedure Code (State Gazette No. 97 of 2025).
The Resolution was adopted unanimously.
Twelve constitutional judges participated in the sitting.
