Today, 16 January 2026, the Constitutional Court initiated Constitutional Case No. 1/2026 at the request of the Supreme Bar Council to establish the unconstitutionality of the following provisions of the Penal Procedure Code (PPC) (published in State Gazette No. 86 of 2005, last amended and supplemented in No. 97 of 2025):
- Article 368, paragraph 3 of the PPC;
- Article 368, paragraph 2 of the PPC, second sentence in the part: "to the prosecutor under paragraph 3." and § 8 of the Transitional Provisions of the Law Amending and Supplementing the PPC, (published in State Gazette No. 97 of 2025), as contrary to Art. 56 in conjunction with Art. 4, para. 1 and para. 2, Art. 88, Article 117, paragraph 1, and Article 122 of the Constitution of the Republic of Bulgaria.
