At its sitting on December 11, 2025, the Constitutional Court ruled to terminate proceedings in constitutional case No. 5/2025. The case was initiated at the request of the Supreme Administrative Court in administrative case No. 1077/2025 to establish the unconstitutionality of the provisions of §16 of the Transitional and Final Provisions of the Law Amending and Supplementing the Judiciary Act (published in State Gazette No. 6 of 2025) and Article 33(4) of the Judiciary Act (published in State Gazette No. 64 of 2007, last amended in State Gazette No. 87 of 2025).
In the course of the proceedings, prior to the ruling on the merits, on 01.12.2025, the Constitutional Court received Resolution No. 12221 of 01.12.2025 of the Supreme Administrative Court, Sixth Division, terminating administrative case No. 1077/2025 due to the withdrawal of the appeal on which it was based.
With the termination of the proceedings before the referring court, the requirement under Article 150(2) of the Constitution for the existence of a specific case before it to which the contested law is applicable ceases to be fulfilled.
The Resolution was adopted with 10 votes in favor and a dissenting opinion by Borislav Belazelkov.
Concurring opinions on the case were presented by Judges Atanas Semov and Orlin Kolev.
Eleven constitutional judges participated in the sitting.
