At its sitting on December 2, 2025, the Constitutional Court ruled on constitutional case No. 9/2024, reported by Judge Nadezhda Dzhelepova.
The Court rejected the request of the Supreme Bar Council to establish the unconstitutionality of the provision of Article 129, paragraph 6, in the part "with the exception of mandatory insurance contributions," of the Tax and Social Security Procedure Code (published in State Gazette No. 105 of 2005, last amended in No. 65 of 2025). The request sets out the grounds for the alleged inconsistency of the contested provision with Article 4, paragraph 1, Article 6, paragraph 2, Article 7, and Article 17, paragraphs 1 and 3, of the Constitution.
During the vote, the majority of votes required by Article 151(1) of the Constitution and Article 15(2) of the Constitutional Court Act (CCA) from more than half of the judges of the court (at least seven votes) was not achieved, and therefore the request was rejected.
According to judges Nadezhda Dzhelepova, Desislava Atanasova, Galina Toneva, Sasho Penov, Nevin Feti, and Orlin Kolev, the request is unfounded because the provision in the contested part is not unconstitutional.
According to judges Pavlina Panova, Atanas Semov, Krasimir Vlahov, Yanaky Stoilov, Sonya Yankulova, and Borislav Belazelkov, the contested provision is unconstitutional.
Each of the two groups of judges presented reasons justifying their position.
