 At its sitting on 16 September 2025, the Constitutional Court delivered its ruling on Constitutional Case No. 10/2025, admitting for consideration on the merits the request of 58 Members of the 51st National Assembly to establish the unconstitutionality of the Resolution on the election of Deputy President of the National Audit Office – Silvia Rusanova Kadreva, adopted by the National Assembly on 16 May 2025 (promulgated in State Gazette No. 42/2025).

The Constitutional Court dismissed as inadmissible the request of the Members of Parliament to establish the incompatibility of Dimitar Glavchev in holding the public office of President of the National Audit Office and terminated the proceedings in that part, since the Court lacks competence to rule on incompatibility of persons occupying the office of President of the National Audit Office. The Constitutional Court has competence to establish incompatibility only with respect to Members of Parliament under Article 72, paragraph 2 in conjunction with paragraph 1, point 3 of the same article of the Constitution, and with respect to Constitutional Court judges under Article 152 of the Constitution in conjunction with Article 12, paragraph 1, point  12 of the Constitutional Court Act. The competence to establish incompatibility of a person holding the public office of President of the National Audit Office has been entrusted by the legislator to the Commission for Anti-Corruption (Article 13, paragraph 1, point 8 of the Anti-Corruption Act).

The order was adopted unanimously.
All twelve Constitutional Court judges participated in the sitting.
