  DECISION No. 14 OF SEPTEMBER 12, 1995 ON CC No. 23/95

Motion by a group of Members of Parliament asking for a binding interpretation of the provision of Art. 106 of the C. in the section in which the Council of Ministers is said to be free to organize the management of the state's assets. They asked for clarification of this power in relation to the application of the constitutional principle of the separation of powers.
The Constitutional Court's interpretative decision ruled that the Council of Ministers shall organize the management of the state's assets under Art. 106 of the C. in a way that corresponds to the hierarchy and competence of the state bodies and does not mar their prestige. In the exercise of this power the Council of Ministers shall not impede the operation of Constitution-established bodies like the President's Office, the National Assembly, the courts and the Constitutional Court.
The Council of Ministers shall not command on state property where the listed state institutions are accommodated by unilateral acts as appropriate except with the specific consent of these institutions.
